My private practice is focused on property related legal actions and proceedings, statutory compliance and property management challenges. I use my court experience, local agency knowledge and decades of property management to find the best outcome under the circumstances for individuals, families and businesses.
With fourteen years of litigation practice in the New York City Civil Court, Housing Part, as a landlord attorney, I have experience with the legal issues surrounding housing, property rights and return of possession. I have commenced and litigated dozens of for-cause holdover and nuisance proceedings, and hundreds of non-payment proceedings. Along with numerous HP Action and building violation defense, I can practically and efficiently resolve ownership and operational challenges.
In like kind, my legal experience allows my defense of tenancy rights, both to maintain habitability standards and to ensure tenants only pay what they are legally bound under lease and the law. Tenants who deal in good faith deserve fair treatment and the opportunity to exercise their rights.
As a former in-house counsel for a non-profit that serves individuals with mental health challenges, respect for capacity and disability issues guides my representation and professional work. I am currently a Part 36 attorney for the Guardianship and Fiduciary Services for the NYS Unified Court System.
Additionally, my experience as the Borough Enforcement Attorney for Brooklyn and Staten Island for The NYC Department of Buildings provided an opportunity to service my community and gain knowledge to navigate complex regulatory and statutory property issues. Whether the best course is to mediate a dispute or to enforce lease provisions in court, I will work with a client to provide good counsel along with vigorous representation.
Lastly, I am an experienced property manager in New York City. I currently manage a portfolio of four buildings with seventeen apartments and one commercial space in Park Slope, Brooklyn. To maximize economic success with rental units or commercial spaces, a focus on good landlord-tenant relationships, well drafted leases, knowledge of local laws, good and sufficient notices, and anticipating future challenges are key factors for success.
My advice to individuals with legal issues or an interest in seeking relief under the law: Let’s talk in confidence about the issue you are facing and find out if I can assist you to resolve the issue in your favor, or if not, my best recommendation for what assistance you need to seek out next.
My advice to landlords always remains the same. Follow the law, anticipate future liability and costs, and maintain good landlord-tenant relationships with tenants. I am interested assisting clients that maintain reasonable economic expectations for their properties or rental units and believe in fair dealing. I do not participate in frivolous litigation or harassment.
Please feel free to reach out by phone or email. We can discuss your issue in confidence, and if representation is warranted and agreed to, the fees for the legal work and counsel I will provide.
Thank you again for visiting my website.
Sincerely,
Charles Wolfe McMellon, Esq.
