by Charles W. McMellon, Esq.

My private practice is focused on property related legal actions, residential and commercial landlord-tenant proceedings, statutory compliance, construction, and property management challenges. I am seeking property related cases that require experience and attention.
My experience with numerous for-cause holdover and nuisance proceedings, complex non-payment proceedings, Housing Part actions defense and various real estate transactions informs my practice and counsel. This experience also affords the ability to defend tenancy rights and maintain habitably standards. Additionally, two years as the Borough Enforcement Attorney for Brooklyn and Staten Island for The Department of Buildings provided the opportunity to learn and navigate complex regulatory and statutory issues. Whether the best course is to mediate a dispute and find common ground or to enforce a lease provision, I will work together with a client to offer good counsel and find the best outcome available under the circumstances.
Practicing in the NYC Civil Court, Housing Part for ten years, I commenced and litigated hundreds of cases. Respect for capacity and disability issues informs my representation and professional work. Additionally, two years as the Borough Enforcement Attorney for Brooklyn and Staten Island for The Department of Buildings afforded the knowledge to navigate complex regulatory and statutory issues. Regardless of whether the best course is to mediate a dispute and find common ground or to enforce lease provisions under the law, I will work together with a client to give good counsel and find the best outcome available under the circumstances.
I am also an experienced property manager in New York City. I currently manage a portfolio of four buildings and twelve apartments in Park Slope, Brooklyn. To maximize success with rental units or commercial spaces, my experience guides a focus on good landlord-tenant relationships, knowing the local laws, respect for tenant privacy, good notice of issues and changes, and to anticipate future challenges.
My message to individuals with legal issues or an interest in seeking relief for damages, pain and suffering is this: Let’s talk in confidence about the issue. Find out if I can assist you to resolve in your favor, or my best recommendation for what assistance you need to seek out next.
My message to landlords remains the same. Follow the law, anticipate future liability and costs, and maintain a good landlord-tenant relationship with tenants. I am interested in clients that believe in fair dealing and maintain reasonable economic expectations for their properties. I do not participate in frivolous litigation or no defense holdovers with market rate tenants for large landlords.
Please feel free to reach out by phone or email. We can discuss your issue confidentially, and if representation is warranted and agreed to, fees for the legal work and counsel I will provide.
